EBSC V. Trump - Temporary Restraining Order, November 19 2018

In a blow to Trump’s illegal and immoral immigration agenda, on November 19, 2018, federal Judge Jon Tigar granted a temporary restraining order blocking Trump’s asylum ban.

In his opinion, Judge Tigar wrote, “The rule barring asylum for immigrants who enter the country outside a port of entry irreconcilably conflicts with the Immigration and Naturalization Act (INA) and the expressed intent of Congress. Whatever the scope of the President’s authority, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden.” The order remains in effect until further arguments are heard on December 19th.
